Lexington Public Schools filed a condemnation petition October 21, 2025 in Dawson County Court seeking to acquire property at 1505 North Adams Street through the eminent domain process. The parcel, formerly associated with Plum Creek Care Center and various healthcare-related entities, is located near existing district facilities. According to court filings, the school district says it needs the property to construct a parking lot and accommodate future expansion of district facilities.
The petition states that the district selected the site because it is adjacent to or near current school property, provides good access to existing street infrastructure, and offers what officials describe as a safe and appropriate location for students, staff, and visitors. School officials contend the acquisition serves a public purpose and is authorized under Nebraska law governing school districts and eminent domain proceedings.
Court documents indicate the district notified property owners and lienholders of its intent to acquire the property in July 2025 and held a public hearing later that month outlining the project and the rights of affected parties.
The district says it subsequently conducted good-faith negotiations and made one or more purchase offers based on an independent appraisal. However, the filing alleges that the owners and numerous entities holding mortgages, leases, liens, or other interests in the property did not accept the offers.
In May 2026, three court appointed appraisers submitted their report determining the value of the property and any damages owed to interested parties at $1.134 Million.
The landowners – Lexington Investors LLC, Kismet LXN LLC, Kismet HD LLC and Lantis Enterprises Inc. – aren’t satisfied with that valuation. They have formally appealed the appraisers’ ruling, asking the Dawson County District Court to take a closer look at whether the compensation accurately reflects the value of the property being taken.
Meanwhile, the school district has deposited $1.134 million with Dawson County Court, the amount awarded by a panel of court-appointed appraisers for property being acquired through condemnation proceedings.
